These terms of use (“Terms of Use”) govern your access and use of the Planetair Centre’s (“Planetair,” “we,” “us,” “our”) website(s) located at planetair.ca and app.planetair.ca (the “Website”). Please read the following Terms of Use before using the Website. By accessing and using the Website, you agree to be bound by all the Terms of Use set forth herein. If you do not agree with these Terms of Use, your sole recourse is to cease using the Website immediately. A copy of these Terms of Use may be downloaded, saved, and printed for your reference.

Our Website may link to other external resources (such as websites, mobile applications, etc.). Consequently, Planetair cannot be held liable and makes no warranty or representation whatsoever as to the accuracy, timeliness, and/or completeness of the information contained on such websites.

The Website is owned and operated by Planetair. Any and all content, data, graphics, photographs, images, audio, video, software, systems, processes, trademarks, trade names, and other information contained on the Website (collectively, the “Content”) are proprietary to Planetair or third-party licensors. The Content is protected by Canadian, United States, and international copyright and trademark laws.

 

Open Use Policy

Planetair publishes all content (except for photos, see Point 4) under a license based on the Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International (CC BY-NC-SA 4.0) licence. We require that: 

  • Attribution to Planetair is given and a link to the URL where the original content can be found is included.

  • The material is not used for commercial purposes.

  • If the material is remixed, transformed, or built upon, distribution of this altered material must also be under a similar licence.

Under this licence, users of the Website are encouraged to use Planetair published material for their own non-commercial use.

Republishing Planetair Reports and Linking to planetair.ca and app.planetair.ca URLs

We do not allow for our published reports and other publications (“Reports”) to be reproduced or otherwise made available for download on non-Planetair websites without prior permission. We request that you use the planetair.ca orapp.planetair.ca URL when linking to our Reports. This ensures we can accurately track the use of our research and communications outputs for evaluation purposes. 

Permission is not required for the use of planetair.ca or app.planetair.ca links on outside websites. We encourage links to our Website wherever possible.

Most photos found on the Website, in Planetair publications, and in communications outputs are acquired from third-party stock photo providers. We cannot give permission for the use of these photos.

Planetair reserves the right to change these Terms of Use at any time and to notify you by posting an updated version of the Terms of Use on the Website. When we do, we will revise the updated date at the top of this page. Additionally, Planetair reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Website (or any part thereof) with or without notice. You are responsible for regularly reviewing the Terms of Use, including, without limitation, by checking the date of “Last Update” at the top of this document. Continued use of the Website after any such changes shall constitute your consent to be bound by such changes, with continued provision of the use of the Website constituting consideration from Planetair to you for so being bound. Your only right with respect to any dissatisfaction with (1) these Terms of Use (2) any policy or practice of ours in operating the Website or (3) any content available through the Website is to stop visiting and using the Website.

Although we strive to update and keep accurate as much as possible the content contained on the Website, errors and/or omissions may occur, and we cannot guarantee it is accurate and complete at all times.

Accordingly, to the extent permitted by applicable law, the Website, including the content provided herein, is being provided on an “as is” and “as available” basis and without any warranties or conditions of any kind, either express or implied. Planetair disclaims all warranties and conditions, express or implied, including, but not limited to, implied warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement. “Centre Planetair”, “Planetair Centre”, and “Planetair” are trademarks of Planetair. All non-Planetair trademarks appearing on the Website are property of their respective owners. Our trademarks may not be used in any manner for any purpose without our express written consent.  

 

9. Applicable Laws

These Terms of Use shall be governed by and construed in accordance with the laws of the Province of Québec and of the laws of Canada applicable therein, and any dispute is to be submitted to a court of competent jurisdiction in the judicial district of Montreal, Province of Quebec.  

If any provision of these Terms of Use is held to be unlawful, void, or for any reason unenforceable, then such provision shall be severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions. A printed copy of these Terms of Use and of any notice in electronic form shall be admissible in any judicial or administrative proceedings to the same extent and under the same conditions as other business documents and records originally generated and maintained in printed form.

You acknowledge that you have read and agree to these Terms and Conditions. These Terms of Use, including any documents referenced herein, constitute the entire agreement between you and Planetair with respect to the Website.
